The Supreme Court has ruled that the Minister for Justice must reconsider a decision to remove an Algerian man with alleged links to Islamic terrorism from the State.

The State claimed the man, who cannot be named for legal reasons, is involved with Islamic terrorism and was convicted of terrorism offences in Algeria and France.

The Minister issued a deportation order after gardaí informed the Department of Justice the activities of the man and his associates were “of serious concern” and “contrary to the State’s security”.

A High Court judge has found that singer Tommy Fleming suffered “a serious setback” following illegal broadcasts of his Voice of Hope DVD on an Irish television station and is entitled to damages.

The singer, his wife and manager Tina Mitchell Fleming and their company TF Productions were awarded a total of €150,000 damages against the broadcaster Irish TV, which is currently in liquidation.

They had sued Irish TV after the station broadcast a promotional DVD sent out by the singer in relation to his 2004 recording “Voice of Hope” under the title the “Tommy Fleming ….read more

A High Court judge has urged parties involved in a row over damage allegedly caused to houses located near the site of the new National children’s Hospital in Dublin to consider going to mediation.

The comments were made by Mr Justice Paul Gilligan after proceedings taken by several residents from the O’Reilly Avenue, Ceannt Fort, Mount Brown areas against the National Paediatric Hospital Development Board and BAM Civil Limited, the firm which is building the hospital, came before the court.

The Supreme Court has reserved its decision in an appeal by Wicklow man, alleged to be an administrator of a website which dealt with illegal drugs and hacking software, against an order for his extradition to the United States.

The appeal has been brought by Gary Davis (29) of Johnstown Court, Kilpedder, Co Wicklow
who is wanted by US authorities to face trial on charges including conspiracy to distribute narcotics, conspiracy to commit computer hacking and conspiracy to commit money laundering in connection with the Silk Road website.

A man who injured his shoulder while loading a horse onto a lorry for well-known trainer Margaret Mullins has been awarded €92,000 damages by the High Court.

65-year-old James Foley sued Ms Mullins of Canterbrook Stud, Doninga Goresbridge Co Kilkenny arising out of an incident that occurred at the Stud on November 18th, 2013.

Mr Foley said he sustained the injuries after a horse he placed into a lorry became spooked, causing him to fall.

Giving judgement, Mr Justice Michael Hanna said he was satisfied the defendant had been negligent and Mr Foley was entitled to damages totalling €92,000 plus his legal ….read more

Two men wanted in Northern Ireland on charges including the attempted murder of a PSNI officer have launched High Court challenges over an alleged failure by Gardai to provide them with information and records following their arrest in 2015.

The applications have been brought by Ciaran MaGuire and Sean Paul Farrell, who are wanted in connection with attempted murder of a police officer in 2015 and possession of explosives with intent to endanger life.

They have both objected to their extradition on grounds including they fear for their wellbeing, health and safety.

A row over the blocking of a lane in North Co Dublin which resulted in residents cars being cut off from the main public road has come before the High Court.

The proceedings were brought over a strip of land known as Valley Lane, the Burrow, Portrane Co Dublin after its owners Kieran and his wife Maura Morrissey alleged locked a gate, put down stones and dug a trench on the lane preventing the residents from being able to access their properties.

A Dublin businessman who claims he is being harassed by the Gardai has launched High Court proceedings aimed at preventing members of the force from watching or besetting him.

The action has been brought by Francis McGuinness, who sells articulated trucks and other related machinery, who alleges that for several years he has been intimidated, harassed and has had property seized from him by the Gardai.

The High Court has ruled that a financial fund is entitled to judgement of €8.7m against a Co Galway based developer.

Mr Justice Max Barrett in his judgement found that Seaconview Designated Activity Company is entitled to a summary judgement against Mr John Lally, of Drimcong House, Moycullen Co Galway.

He had opposed the application for judgement and had argued the case should go to a full hearing on several grounds, including that there had been an unreasonable and excessive delay by Seaconview is seeking judgement against him.
