The former CEO of Irish Life and Permanent, jailed for his role in a €7.2 billion fraud about the true health of Anglo Irish Bank in 2008, has withdrawn an appeal against the severity of his prison sentence.

Last month, the Court of Appeal upheld the criminal convictions of Denis Casey and John Bowe, who were found guilty by a jury at Dublin Circuit Criminal Court in July 2016 of conspiring to mislead investors by using interbank loans to make Anglo appear €7.2bn more valuable between March 1 and September 30, 2008.

The criminal prosecution of businesswoman Deirdre Foley over the handling of collective redundancies at Clery’s Department Store is set to proceed.

Ms Foley and D2 Private Ltd, the business she owns, were due to appeal an order of the High Court delivered last October refusing them certain reliefs concerning the legality of an investigation by inspectors of the Workplace Relations Commission into the Clery’s redundancies.

The High Court case centred on whether entry by the inspectors into the Harcourt St premises of D2 Private Ltd was lawful.

A man who escaped from an open prison and was at large for almost five years, during which time he collected social welfare and fathered a child, faces arrest and a return to prison to complete his sentence.

Mark Finnegan, whose family home is in Jobstown in Tallaght, was convicted in November 2008 of allowing himself be carried in a mechanically propelled vehicle without the consent of the owner.

He was sentenced to 16 months imprisonment on May 27, 2009, the first two months of which were spent in Wheatfield prison at which point he was transferred to Shelton Abbey open prison.

A former GAA coach jailed for sexually abusing five boys in the 1980s has had his conviction upheld by the Court of Appeal.

Ronan McCormack (75), of Cuppanagh, Cloonloo, Co Sligo, was found guilty by a jury at Sligo Circuit Criminal Court of 53 counts of indecently assaulting five boys aged between 10 and 13 at various locations between October 1981 and August 1986. He had denied the charges.

McCormack was sentenced to seven years and 10 months imprisonment with the final two years suspended by Judge Petria McDonnell on July 25, 2014.

A truck driver whose dangerous driving left a cyclist consigned to a wheelchair, and with a shortened life expectancy of up to 30 years, has had his 15-year driving ban upheld by the Court of Appeal.

Tim Walsh (52) from Moneen, Glamworth, Co Cork, had pleaded guilty at Cork Circuit Criminal Court to dangerous driving causing serious bodily harm to cyclist Vincent O’Driscoll on the Cork—Moneen road in August 2013.

Walsh was jailed for three years and disqualified from driving for 15 years by Judge Seán O’Donnabháin on July 30, 2014.

A man who claimed to be “overwhelmed by the enormity” of being sent to jail for six years for abusing his nephew is seeking an extension of time to appeal his sentence, after lodging an appeal 17 months late.

The 43-year-old man, who details cannot be published to protect the victim’s identity, pleaded guilty at the Central Criminal Court to the rape and sexual assault of his younger nephew in Limerick over four years in the 1990s. The man was aged 17 while the victim was aged 12 when the abuse commenced, the Court of Appeal heard.

The High Court has refused to order the extradition of Ian Bailey to France in relation to the death of Sophie Tuscan du Plantier, dismissing the Minister for Justice’s application as an “abuse of process”.

Mr Bailey (60) of The Prairie, Liscaha, Schull, west Cork, denies any involvement in the death of Ms du Plantier, who was found dead outside her holiday home in Schull in December 1996.

French authorities previously sought the surrender of Mr Bailey in 2010 but this application was refused by the Supreme Court in 2012. A second extradition request was transmitted ….read more

Lawyers for a former bank executive jailed for his role in a €7.2 billion fraud about the true health of Anglo Irish Bank in 2008 are seeking a Supreme Court appeal.

A Kilkenny man who claimed he was in a consensual sexual relationship with his younger cousin has moved to appeal his conviction for rape and sexual assault of the then 14-year-old.

The 49-year-old man, who cannot be named to protect the identity of the now 33-year-old man, was convicted by a Central Criminal Court jury of 15 counts of rape and oral rape and one charge of sexual assault following a trial. He had pleaded not guilty to 35 counts, the balance of which were the subject of directed verdicts of not guilty by the trial judge.

A 71-year-old woman who had difficulty “staying wide awake” during High Court proceedings is to be surrendered to the UK where she faces charges of allegedly assisting in the rape of her daughter 40 years ago.

The UK citizen, with an address in Co Roscommon but who cannot be identified for legal reasons, is accused of indecently assaulting her daughter and jointly raping her with her then husband at addresses in West Sussex and Devon on dates in the late 1970s.
