The High Court has refused to order the extradition of Ian Bailey to France in relation to the death of Sophie Tuscan du Plantier, dismissing the Minister for Justice’s application as an “abuse of process”.

Mr Bailey (60) of The Prairie, Liscaha, Schull, west Cork, denies any involvement in the death of Ms du Plantier, who was found dead outside her holiday home in Schull in December 1996.

French authorities previously sought the surrender of Mr Bailey in 2010 but this application was refused by the Supreme Court in 2012. A second extradition request was transmitted ….read more

Two men wanted in Northern Ireland on charges including the attempted murder of a PSNI officer have launched High Court challenges over an alleged failure by Gardai to provide them with information and records following their arrest in 2015.

The applications have been brought by Ciaran MaGuire and Sean Paul Farrell, who are wanted in connection with attempted murder of a police officer in 2015 and possession of explosives with intent to endanger life.

They have both objected to their extradition on grounds including they fear for their wellbeing, health and safety.

A High Court judge is to deliver a decision on whether two men arrested over the discovery of a firearms cache in a business park are to be granted bail.

James Walsh (33), with addresses at Wheatfield Avenue, Clondalkin and Neilstown Drive, Clondalkin and Jonathan Harding (44) of McNeil Court, Sallins, Co Kildare are facing charges, under the Firearms Act, for unlawful possession of five revolvers, 20 rounds of ammunition and a silencer on January 24 at a unit in Greenogue Business Park, in Rathcoole, Co Dublin.

A row over the blocking of a lane in North Co Dublin which resulted in residents cars being cut off from the main public road has come before the High Court.

The proceedings were brought over a strip of land known as Valley Lane, the Burrow, Portrane Co Dublin after its owners Kieran and his wife Maura Morrissey alleged locked a gate, put down stones and dug a trench on the lane preventing the residents from being able to access their properties.

A Dublin businessman who claims he is being harassed by the Gardai has launched High Court proceedings aimed at preventing members of the force from watching or besetting him.

The action has been brought by Francis McGuinness, who sells articulated trucks and other related machinery, who alleges that for several years he has been intimidated, harassed and has had property seized from him by the Gardai.

The High Court has ruled that a financial fund is entitled to judgement of €8.7m against a Co Galway based developer.

Mr Justice Max Barrett in his judgement found that Seaconview Designated Activity Company is entitled to a summary judgement against Mr John Lally, of Drimcong House, Moycullen Co Galway.

He had opposed the application for judgement and had argued the case should go to a full hearing on several grounds, including that there had been an unreasonable and excessive delay by Seaconview is seeking judgement against him.

A High Court action has been launched over alleged damage to houses located beside the site of the new National children’s Hospital in Dublin.

The proceedings have been taken from several residents from the O’Reilly Avenue, Ceannt Fort, Mount Brown areas against the National Paediatric Hospital Development Board and BAM Civil Limited, the firm which is building the hospital.

The residents claim their homes have been damaged as a result of certain works being carried out by the defendants.

A 71-year-old woman who had difficulty “staying wide awake” during High Court proceedings is to be surrendered to the UK where she faces charges of allegedly assisting in the rape of her daughter 40 years ago.

The UK citizen, with an address in Co Roscommon but who cannot be identified for legal reasons, is accused of indecently assaulting her daughter and jointly raping her with her then husband at addresses in West Sussex and Devon on dates in the late 1970s.

The barrister for a 40-year-old Belfast man wanted in Northern Ireland to face prosecution in connection with the murder of prison officer David Black has told the High Court that there is “a real risk” he faces inhumane treatment should he be extradited.

Damien Joseph McLaughlin, with an address at Glenties Rd, Belfast, was arrested in County Donegal last March on foot of a European Arrest Warrant issued by Northern Ireland authorities.

A bank-appointed receiver has launched a High Court action aimed at securing possession of “a palatial eight bedroom mansion” described as being similar to something that featured in the popular 1980′s TV series “Dallas.”

The proceedings have been brought in respect of a property known as the Grange or Grange House Ballyboughal in Co Dublin, which it is claimed has been unlawfully re-occupied by its owners Jeremiah, otherwise Jerry, Donovan and his wife Bridget Donovan.
