Mayo man took decision to kill elderly brothers in “acts of extreme violence”, State tells jury

A prosecutor has told a double murder trial that the accused had made a decision to kill two elderly brothers in acts of extreme violence.

However, the defendant’s barrister said that the ‘poisoned gift’ of mental disorders he’d been given at birth had played a role in his ‘disgusting and repulsive acts’ and thus diminished his responsibility.

Both sides gave their closing speeches to the Central Criminal Court today in the trial of 30-year-old Alan Cawley.

Mr Cawley of Four Winds, Corrinbla, Ballina, Co Mayo has admitted killing Thomas Blaine (69) and John (Jack) Blaine (76). However, he has pleaded not guilty to ….read more

Gardai had to produce firearms after father-of-three refused to get out of stolen car

A father of three who refused to get out of a stolen vehicle when ordered to by gardaí, forcing officers to produce their firearms in heavy traffic, has been jailed for six months.

Gardaí thought the car Michael Boylan (45) was driving had suspicious looking number plates when he was stopped in traffic in the St Margaret’s area of Dublin.

The vehicle had traffic behind it, to the front of it and to one side of it when Detective Garda Damien Rogers pulled up his patrol car along the other side of it. He recognised both Boylan and his passenger and ordered ….read more

Journalist deemed unfit to stand trial for murder is committed to Central Mental Hospital

A 44-year-old woman with Schizoaffective disorder, who is unfit to stand trial for the murder of a man in his South Dublin home in 2014, has been committed to the Central Mental Hospital.

Mercy Peters, originally from Sierra Leone, is charged with murdering Tyrone McKenna (42) on July 17, 2014 at the house they had shared in Marley Court, Rathfarnham, Dublin 14.

Last week at the Central Criminal Court, as a result of hearing evidence from two consultant psychiatrists that Ms Peters is suffering from Schizoaffective disorder, Mr Justice Tony Hunt found her unfit to stand trial.

Kilkenny man who claimed he was in consensual sexual relationship with young cousin appeals conviction

A Kilkenny man who claimed he was in a consensual sexual relationship with his younger cousin has moved to appeal his conviction for rape and sexual assault of the then 14-year-old.

The 49-year-old man, who cannot be named to protect the identity of the now 33-year-old man, was convicted by a Central Criminal Court jury of 15 counts of rape and oral rape and one charge of sexual assault following a trial. He had pleaded not guilty to 35 counts, the balance of which were the subject of directed verdicts of not guilty by the trial judge.

Limerick man found not guilty of threatening to kill pensioner

A Limerick man has been found not guilty of threatening to kill and damage the property of another man.

The presiding judge at the Special Criminal Court said that although Larry McCarthy Jnr’s actions were “reckless, ill-considered and irresponsible”, the court was acquitting him of the charges.

Mr McCarthy Jnr (37), with addresses at the Old Cork Road and Cornmarket Villas in Limerick, had denied threatening to kill Noel Moore (74) and threatening to damage Mr Moore’s property at Windsor House, Donoughmore, Limerick on July 28th, 2015.

Whistleblower forced to “retreat to garda station” after confrontation with accuser’s family

Garda whistleblower Sergeant Maurice McCabe was forced to retreat into his garda station following a confrontation with family members of the young woman who alleged he sexually assaulted her, the Charleton tribunal heard.

In 2007 the DPP recommended against bringing charges in the case, saying there was no evidence an offence had been committed. The tribunal is looking at claims there was a smear campaign against Sgt McCabe.
