Intoxication led Mayo man to extremely violent acts, psychiatrist tells murder trial

A forensic psychiatrist for the State has told a Mayo man’s murder trial that he was voluntarily intoxicated, leading him to act in ‘an extremely impulsive and violent way’, when he killed two elderly brothers with special needs. She said he did not have a mental disorder in law.

It follows the evidence of a defence psychiatrist, who told the Central Criminal Court that Alan Cawley had three mental disorders at the time, which had diminished his responsibility for his actions and would give the jury the option of finding him guilty of manslaughter rather than murder.

Garda whistleblower Maurice McCabe no longer trusted anybody after a complaint of child sexual assault was made against him, the Charleton tribunal has heard.

The tribunal is looking into whether Sgt McCabe was the target of a smear campaign on the direction of senior Garda management.

On day 14 of the tribunal, Superintendent Noel Cunningham gave evidence of conducting an investigation in late 2006 and early 2007 into a sex assault allegation made by the teenage daughter of a garda colleague of Sgt McCabe.

A 30-year-old woman who drove a man who loved her into a deep harbour, where he drowned, must wait to hear the outcome of an appeal against her conviction for murder.

Marta Herda, of Pairc Na Saile, Emoclew Road, Arklow, Co Wicklow, knew her passenger could not swim when she drove her Volkswagen Passat through the crash barriers at South Quay, Arklow shortly before 6am on March 26, 2013.

71-year-old woman to be extradited on charge of assisting in rape of her daughter

A 71-year-old woman who had difficulty “staying wide awake” during High Court proceedings is to be surrendered to the UK where she faces charges of allegedly assisting in the rape of her daughter 40 years ago.

The UK citizen, with an address in Co Roscommon but who cannot be identified for legal reasons, is accused of indecently assaulting her daughter and jointly raping her with her then husband at addresses in West Sussex and Devon on dates in the late 1970s.

Jury watches CCTV footage of moment biker was shot dead

A murder trial jury was today shown CCTV footage of the moment a biker was shot dead at the gates of his motorcycle club.

The jury were shown a sawn-off shotgun gardai found in a wooded area behind the accused man’s home and also heard that a search of the club premises yielded a bullet-proof vest and weapons including an improvised firearm and a pipe bomb.

Alan ‘Cookie’ McNamara (51), from Mountfune, Murroe, Co Limerick has pleaded not guilty to the murder of Andrew O’Donoghue on June 20, 2015 at Mountfune.

Murder accused did not have mental disorders in law, forensic psychiatrist tells trial

A forensic psychiatrist for the State has told a Mayo man’s murder trial that although he had personality disorders when he killed two elderly brothers with special needs, they did not qualify as mental disorders in law.

It follows the evidence earlier this week of a defence psychiatrist, who told the Central Criminal Court that Alan Cawley had three mental disorders at the time and that they had diminished his responsibility for his actions.

If satisfied that he had a qualifying mental disorder, the jury could find him guilty of manslaughter rather than murder on the grounds of diminished responsibility.
