McDonald’s robber jumped in to river in false belief he could evade garda helicopter

A man who robbed a McDonald’s restaurant and held a knife to a woman’s stomach in front of customers and children will be sentenced next week.

James Barry (33) fled the Rathmines restaurant with €330 in cash and jumped into the Dodder river to evade gardaí, Dublin Circuit Criminal Court heard today.

He was operating under the delusion the water would ensure his body temperature wouldn’t be picked up by any pursuing garda helicopter, Garda Brian McLoughlin told Noel Devitt BL, prosecuting.

Barry of Goatstown Close, Goatstown, Dublin pleaded guilty to robbing McDonald’s restaurant on Lower Rathmines Rd on February 2 this year.

Bail refused for man charged with murder of Noel Kirwan

A 26-year-old man charged with the murder of Noel Kirwan has been refused bail by the High Court today.

Jason Keating, of Lower Main Street, Rush, Co. Dublin is charged with the murder of Noel Kirwan (62) outside his house at St Ronan’s Drive, Clondalkin, Dublin 22 on December 22, 2016.

Mr Keating had sought bail in the High Court today. However, the State objected to the application.

Inspector Mark O’Neill told the court he believed that if released on bail, Mr Keating would commit further offences and might not stand trial.

The jury in a Dublin murder trial has asked to see the shotgun with which a father-of-one killed a 33-year-old man in 2014.

The jury was about an hour into its deliberations today in the Central Criminal Court trial of the Dubliner, who shot the man in the head and chest, when the request was made.

Seán Ducque, of no fixed abode, has pleaded not guilty to murdering Kieran Farrelly on 26th October 2014 at Killarney Court, Killarney Street in the city.

The jury in a Dublin murder trial has been given the shotgun with which a father-of-one killed a 33-year-old man in 2014.

The jury had requested the weapon during its deliberations in the Central Criminal Court trial of the Dubliner, who shot the man in the head and chest.

Seán Ducque, of no fixed abode, has pleaded not guilty to murdering Kieran Farrelly on 26th October 2014 at Killarney Court, Killarney Street in the city.

Jobstown jury to resume deliberations tomorrow

The jury in the trial of six men accused of falsely imprisoning former Tanaiste Joan Burton is expected to resume deliberations tomorrow.

The jury of seven men and four women retired to consider its verdict on Monday afternoon. They deliberated for 50 minutes before they were told further legal argument was to take place and deliberations were suspended.

Legal argument took place today and the jury will return tomorrow morning.

Secrecy of jury deliberations a “hallmark of our criminal legal system”

Requiring a jury in a criminal trial to explain or give reasons for its verdict is “impractical” and a “recipe for enormous difficulty”, according to the Court of Appeal in upholding a murderer’s conviction.

Garrett O’Brien (40), from Clover Hill in Bray, Co Wicklow, had pleaded not guilty to the murder of 27-year-old father-of-two Seamus O’Byrne at his home in Tymon North Park, Tallaght in March 2009.

He was found guilty by a jury at the Central Criminal Court and was given the mandatory life sentence by Ms Justice Iseult O’Malley on November 6, 2012.
