A 60-year-old man is facing allegations that he held a knife to his 91-year-old father’s throat, threatened to cut his head off and caused a laceration during an incident at their home in Rathfarnham earlier this year.
Joe Kenny, of Glendoher Drive, Rathfarnham, Dublin 16 appeared before Tallaght District Court charged with assaulting his father causing him harm during an alleged incident at their home on 21 February last.
He is also accused of producing a knife during the same incident in a way that was likely to intimidate. The assault charge falls under the Non-Fatal Offences Against the Person Act and the second charge relates to the alleged production of a weapon.
The court heard Gardaí were called to the house following reports that the accused had allegedly threatened to “cut the head off” his father during a row.
When officers arrived, they found the 91-year-old man had sustained a laceration to the skin on his neck. The court was told the wound bled but was not classified as a serious injury. It was alleged the accused had held a six-inch carving knife to his father’s throat during the incident.
The court heard that the alleged injured party withdrew his statement on 29 November however and the DPP must now consider how the prosecution is to proceed.
Judge Patricia McNamara refused jurisdiction due to the seriousness of the charges.
Joe Kenny was remanded on continuing bail and the case was adjourned to 15 January next at Tallaght District Court for a book of evidence to be prepared.
